HOW WE WORK
We will discuss your requirements with you, then offer you a timescale and quotation. If required we will use our professional photographers and library images, all at an agreed cost. You may of course supply your own images, artwork or text, but do have a clear idea of what you want created and tell us. Images should be of high resolution. We can advise on technical matters. We will work up a draft, seeking your input and comments, making changes and adjustments where appropriat, until both parties are satisfied with the design: usually to a maximum of three revisions unless otherwise agreed by us. Checking the final proof is your responsibility and you will be solely responsible for errors after that stage. You can choose to waive the proof stage but you will still remain responsible as if proofing had been carried out.
Quotations are given, subject to sight of clients material and after establishing what our input and resources will be. Exceptionally, quotations may have to be revised. We will always then seek your approval prior to going ahead. If you decline, we will charge for work completed and when paid, release same to you for completion elsewhere. We reserve the right to reject or not complete any job without stating our reasons.

FEES
If you wish to proceed, our fee structure is as follows and may vary only after written agreement from us has been obtained. Printing: 100% of costs prior to starting work. Advertising space: 100% of costs prior to starting work. Design work: 20% paid in advance as a stage payment, the remainder due upon collection or prior to delivery of the work. We understand and will exercise our statutory right to claim interest and compensation for debt recovery and associated costs under the late payment legislation if we are not paid in accordance with our terms above. Please be aware that the daily interest rate is 8% above the prevailing Bank of England base rate. We reserve the right to withhold any job until your account is settled in accordance with the terms herein specified.

COPYRIGHT
You agree and warrant that any material submitted will not violate or infringe any copyright, trademark, patent, law or proprietary rights of others or contain anything libellous or harmful. You agree to indemnify us totally against any damages or costs that may arise in respect of the above.

PROPERTY
We take great care of our clients’ property, but we consider anything sent to us to be entirely at your own risk and will not accept responsibility for any damage or loss however caused. This applies to items actually in our possession too. We return property via normal post unless specifically instructed otherwise. We will expect you to pay postage costs.

CONFIDENTIALITY AND PRIVACY
We will respect your intellectual property and preserve your privacy. Your details will not be shared with any third party outside of the White Dot Publishing Ltd. group of companies.

LEGAL
The contract shall in all respects be governed by English law and shall be deemed to have been made in England and the client and Design Smart agree to submit to nonexclusive jurisdiction of the English courts.
